Terms & Conditions

These Terms & Conditions govern your access to and use of our website and any purchase you make from us. They include our refund terms. Please read them carefully.

1. Acceptance of These Terms

These Terms & Conditions (“Terms”) form a binding agreement between you and Iron Equip Supply (“we,” “us,” or “our”) covering your use of our website at ironequipusa.com and any order you place with us. By using our website or placing an order, you agree to these Terms. If you do not agree, please do not use our website or services.

You must be at least 18 years old and able to enter into a legally binding contract to purchase from us.

2. Products, Descriptions & Availability

We work hard to describe and display our products accurately, but we do not warrant that product descriptions, images, specifications, or other content are complete, current, or error-free. Product appearance may vary from the images shown.

All products are offered subject to availability. We may limit quantities, discontinue products, or correct inaccuracies at any time without prior notice.

3. Pricing

  • Prices are listed in U.S. dollars (USD) and are subject to change at any time without notice.

  • Prices do not include applicable taxes or shipping charges unless expressly stated.

  • If a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel or refuse any order placed at that price, even after an order confirmation has been sent. If your payment has already been taken, we will issue a full refund.

4. Orders & Order Acceptance

Your order is an offer to purchase. An order confirmation email acknowledges that we received your order; it does not constitute our acceptance of it.

We reserve the right to accept, decline, limit, or cancel any order at our discretion — including in cases of suspected fraud, pricing or stock errors, or inability to ship to your location. If we cancel an order after payment has been taken, we will refund you in full.

5. Payment

  • We accept the payment methods shown at checkout. Payments are handled by secure, PCI-compliant third-party processors; we do not store your full card details.

  • By submitting payment, you confirm that you are authorized to use the payment method provided.

  • Your payment method is typically charged at the time your order is placed.

6. Shipping & Delivery

We currently ship within the continental United States only. Delivery timeframes, freight handling, redelivery fees, and inspection requirements are set out in our Shipping & Delivery policy, which is incorporated into these Terms by reference. Title and risk of loss pass to you upon delivery, so please inspect every delivery before signing.

7. Returns & Refund Policy

This section sets out our refund terms and forms part of these Terms. Our full Returns & Refund Policy page provides additional detail and is incorporated here by reference; where there is any conflict, the Returns & Refund Policy page governs.

7.1 Return Window & Eligibility

Eligible items may be returned within 30 days of delivery, provided they are unused, in original condition, and include all original packaging, parts, and accessories. A Return Authorization (RA) number must be obtained from us before returning any item. Used, installed, or operated items, and items returned without authorization, are not eligible.

7.2 How to Request a Return

To start a return, contact us at info@ironequipusa.com with your order number and the reason for return, along with photos where relevant. We will issue an RA number and return instructions. Do not ship items back before receiving an RA number, as unauthorized returns may be refused.

7.3 Refunds

Approved refunds are issued to your original payment method within 5–10 business days after we receive and inspect the returned item; your bank or card issuer may take additional time to post the credit. We refund the purchase price of the returned item. Original shipping charges are non-refundable except where the return is due to our error or a damaged or defective item. Partial refunds may apply where a returned item is not in original condition or is missing parts.

7.4 Return Shipping Costs

We cover return shipping for items that are damaged, defective, or shipped in error. For change-of-mind or incompatibility returns, the buyer is responsible for return shipping. Due to the size and weight of our equipment, freight return costs can be significant.

7.5 Order Cancellations

If an order has not yet shipped, you may cancel it for a full refund by contacting us with your order number. Once an order has shipped, it is handled under the return process above, and freight already in transit may incur return shipping costs for change-of-mind cancellations.

7.6 Damaged or Defective Items

Inspect your delivery before signing. Report any damage on the delivery receipt, photograph it, and contact us within 48 hours of delivery. We will arrange a repair, replacement, or refund as appropriate. Damage reported after 48 hours may affect your eligibility for a freight-damage claim.

8. Warranty

Most products are covered by a manufacturer warranty as described in our Warranty policy, which is incorporated into these Terms by reference. Repair or replacement under the manufacturer warranty is the exclusive warranty remedy. Extended warranty plans may be available on select products at checkout.

9. Intellectual Property

All content on this website — including text, graphics, logos, images, and page design — is owned by or licensed to Iron Equip Supply and is protected by applicable intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the site without our written permission. Third-party product names and brand names remain the property of their respective owners.

10. Acceptable Use

You agree not to use the website for any unlawful purpose, to interfere with its normal operation, to attempt unauthorized access to any part of it, to introduce malicious code, or to infringe the rights of others. We may suspend or terminate access for any violation of these Terms.

11. Equipment Safety

Our products include heavy equipment and machinery. You are solely responsible for installing, operating, and maintaining all equipment safely, by qualified persons, and in accordance with the manufacturer's instructions and all applicable laws and regulations. Always read the owner's manual before use, and use appropriate protective equipment and procedures.

12. Disclaimer of Warranties

Except for the manufacturer warranty that accompanies products and any rights that cannot be excluded under applicable law, the website and its content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the website will be uninterrupted, secure, or error-free.

13. Limitation of Liability

To the maximum extent permitted by law, Iron Equip Supply will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, arising out of or relating to your use of the website or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.

14. Indemnification

You agree to indemnify and hold harmless Iron Equip Supply and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the website or products, or your violation of these Terms or applicable law.

15. Governing Law

These Terms are governed by the laws of the State of Connecticut, USA, without regard to its conflict-of-law rules. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Connecticut.

16. Changes to These Terms

We may revise these Terms from time to time by posting an updated version with a new “Last Updated” date. Your continued use of the website or placement of an order after changes take effect constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Force Majeure

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, severe weather, carrier disruptions, supply-chain interruptions, labor disputes, or governmental actions.

19. Entire Agreement

These Terms, together with our Privacy Policy, Returns & Refund Policy, Warranty policy, and Shipping & Delivery policy, constitute the entire agreement between you and Iron Equip Supply regarding your use of the website and your purchases, and supersede any prior agreements on that subject.
